My neighbor and I were having a discussion about the 3-up rule. So, I looked at the law itself and it says this:
Antlered deer—§ 131.2. Definitions.
(i) In Wildlife Management Units 1A, 1B, 2A, 2B and 2D, a deer having three or more points on one antler, not including brow tines which is the point immediately above the antler burr.
The 2018-19 Digest says:
..three points, including the main beam counted as one of the points, on one side, excluding
the brow tine (the point immediately above the antler burr).
The 2011-12 Digest had stated this:
hunters will be re- quired to abide by “three up;” three points off the main beam on one side, excluding the brow tine (the point im- mediately above the antler burr);
Now, with that as a background, the question arose (as this buck is alive and still around) that the buck has two points on each side......and it has a set of brow tines, .....but (and this is the important part) off of one of the brow tines, is a "kicker" that is obviously longer than one inch.
Other than the "let him go" comments, which is sort of obvious....the "academic" question is....."Is this buck legal to shoot?" (Said buck is in one of the 3-up WMU's).
So.....what say yee?
