Dana requests two (2) stream variance areas and one (1) road variance to construct a portal site, coal stockpile, treatment ponds and support structures within 100 feet of Whiteley Creek, Unnamed Tributary No.3 (UNT #3) of Whiteley Creek, and Creek Road (T411). The proposed activities are located upstream of the intersection of Creek Road and Whiteley Creek. The following variance areas are requested:
A variance is requested for Whiteley Creek for construction of the portal site, coal stockpile, treatment ponds and support structures situated at a point beginning approximately 950 feet upstream of the intersection of T411 and Whiteley Creek, thence continuing 1170 feet downstream.
A variance is requested for UNT #3 of Whiteley Creek for construction of the portal site, coal stockpile, treatment ponds and support structures situated at a point beginning at the junction of UNT #3 and Whiteley Creek, thence continuing 1000 feet upstream along UNT #3.
A variance is requested for Creek Rd for construction of the portal site, coal stockpile, treatment ponds and support structures situated at a point beginning at the intersection of Creek Road and Whiteley Creek and continuing approximately 1070 feet west on Creek Road.
Dana proposes three NPDES points that will discharge treated wastewater and treated mine drainage into Whiteley Creek (WWF) tributary to the Monongahela River. The discharge points are located as follows: Point 001 is located approximately 920 feet upstream of the intersection of Creek Road and Whiteley Creek. Point 002 is located approximately 740 feet upstream of the intersection of Creek Road and Whiteley Creek. Point 003 is located approximately 165 feet downstream of the intersection of Creek Road and Whiteley Creek.
