Breitbart – Mark E. Kelly, gun-control proponent and husband to former Congresswoman Gabby Giffords, recently purchased an AR-15 (an “assault weapon,” he called it)—which he now says he intended as an illustration of the need for more stringent gun laws. Kelly reportedly bought the AR-15 and a 1911-style semi-automatic pistol at a gun store in Tucson, Arizona.

Breitbart News received a tip on this when Neil McCabe, editor of Guns & Patriots newsletter, contacted us on March 7 and said: Mark E. Kelly, made purchases which included an AR-15–sometimes described as an “assault rifle”–at 3:30 pm on the afternoon of March 5 at Diamondback Police Supply, 170 S. Kolb Street, Tucson, AZ.

According to McCabe, witnesses to the purchases claimed Kelly purchased “high capacity” magazines as well.

On March 6, McCabe contacted Kelly’s gun control group–”Americans for Responsible Solutions”–and on March 8 they replied that his message had been passed on to colleagues who handle press requests. Breitbart News then began investigating the details surrounding the purchase, including visiting the gun store.

Suddenly, Kelly announced on his Facebook page that he was not going to keep the AR-15, which he has yet to pick up from the store. Days after making the purchases, Kelly wrote on Facebook:

“I just had a background check a few days ago when I went to my local gun store to buy a .45. As I was leaving, I noticed a used AR-15. Bought that too. Even to buy an assault weapon, the background check only takes a matter of minutes. I don’t have possession of it yet but I’ll be turning it over to the Tucson PD when I do.”

now that he got caught and he claims he bought them not to keep, is he a straw purchaser ?

So, he went through a background check and I assume, that the former astroNUT has nothing in his background that would have sent up a red flag.

Making the purchase proved nothing, except that he is a lying hypocrit.

Just goes to show you the entitlement feeling our goverment and their families have "I can have it but you can't". If he did't pick it up yet why not just cancell the sale, what does buying it and turning it into the police dept. have to do with anything are they going to destroy it or is he donating it to there dept for use? Maybe he is going to start a foundation for kids without guns program but doesn't have all the paper work set up yet?

Wait a second, the guy said...

So he spent hundreds if not a grand plus to buy a firearm he only ever intended to "turn over" to the Tucson PD?

What a hypocritical lying buffoon.

Communist country's often pass laws on to the people the leaders personally have no intention of following. People need to leave the political correctness at the door and when they see these people in public they should call them what it is....a lying hypocrite. We are to blame when we allow Bloomburg to have armed police and not call him out instead we continue to allow these folks to condemn us. Just ask yourself what the founders would do.

In todays issue of the "Arizona Daily Star" on page 1 is the story about the gun purchase. It reports that he had to return to the store with proper ID to get the paperwork finished. He had just moved to Tucson from Huston and did not have his AZ drivers license yet.

His spokswoman, Pia Carusone, took the pictures of him doing the papwrwork and posted the information on his facebook page. This is just some stunt to keep him on the news, but it backfired on him.

I don't believe the story, actually... Do you know how difficult it is to find an AR-15 sitting on the shelf in a gun store these days? Fabrication! :)
There seem to be a few showing up on the shelves in the last week or so , and the price seems to have dropped considerably from just a few weeks ago.hope that is a sign of things to come.

Two of them at local gun shop today.

But more importantly, when you do the ppr work for background check in Pa, there is a question on there that ask if" YOU ARE BUYING THIS GUN FOR YOURSELF"....., judging by the way that reads, I would say it is illegal to purchase a firearm for someone else........ie: Tucson PD...or anyone else for that matter.......

Question #11 of the 4473 asks:

"Are you the actual transferee/buyer of the firearm(s) listed on this form ? Warning: You are not the actual buyer if you are acquiring the firearm(s) on behalf of another person. If you are not the actual buyer, the dealer cannot transfer the firearm(s) to you. ...".

However, if Kelly bought the AR-15 to give to a Police Department, then he would probably fall under the "gift" exclusion, and the transfer would be lawful.

but under AZ law , all firearms handed over to police are auctioned off for sale.

also in AZ a used gun bought by a shop must be held for 20 days before its sold.
so if he was proving a point why wouldnt hee buy a new gun he could walk out that day with. and why a handfull of 30 round mags ?

He is doing the same as many others- panic buying. He has the conceit of the self anointed, but he does not want to be caught without a chair when the music stops.
It is pretty obvious he made up his tale of gifting the gun to the p.d. when he got caught talking out of the other side of his socialist-democrat face.
