No but I would bet a game warden might say that while holding the air rifle while in the woods with the squirrel he would still be hunting which would require wearing the orange .

Common, give the guy a break , the pic could have been taken in his back yard after the hunt, I`ve seen many a deer pic with a hunter holding his gun with his deer and no orange, I think you are nit picken, that seems to be done quite on this site....
