its legit, guy has sheds of the deer from past years. he lives up there, but isnt originally from there. not sure if he works at the sawmill as stated earlier
Ok I know the guy personally, he's not from marienville orig. but YES he does live here...NO the deer was NOT from marienville it is from out near Tionesta.
my brother just sent me a text with a pic of the buck its a hawg!! big drop tine an all just a huge buck,, for the area its probally the biggest takin in yrs.. when i live up there never seen one that big..
i am from the area and i work in marienville, and am very curious to hear/see more about this. i'll keep my eyes on this thread to see if anything develops.
Legally he owns the pictures of the deer, he took them all and shared them with friends, but still owns rights to them and by law if anyone posts them it is an invasion of privacy. Have some respect and let the owner decide what he wants.
Once you send the picture with your phone, your ownership is basically forfeited, with no usage agreement in place before hand you are giving up your right to privacy. If you want privacy, don't share the picture in the first place. There ain't any deer left in Marienville anyway. heh heh.

Mr Regular Joe - there are laws that protect the owner of the photo no matter who sent it to who. There are laws called "Fair USE" and its a violation to use a picture without the owners consent...it says NOTHING about transfer of ownership due to texting or emailing it. If that were the case more than quite a few would be able to claim ownership. Those that received the picture via these methods were technically breaking the law by sending along to the next person if they didn't specifically ask the owner before doing so. I know the person who actually took the pictures and he didn't text these pictures to one person..so he still owns them and has legal rights to them.
Here's what I learned about Fair Use:
It DOESN'T MATTER...
if you link back to the source and list the photographer's name
if the picture is not full-sized (only thumbnail size is okay)
if you did it innocently
if your site is non-commercial and you made no money from the use of the photo
if you didn't claim the photo was yours
if you've added commentary in addition to having the pic in the post
if the picture is embedded and not saved on your server
if you have a disclaimer on your site.
if you immediately take down a pic if someone sends you a DMCA notice (you do have to take it down, but it doesn't absolve you.)
NONE OF THAT releases you from liability. You are violating copyright if you have not gotten express PERMISSION from the copyright holder OR are using pics that are public domain, creative commons, etc.
Since we're going to fight over the legality of posting a picture, we're going to move on.
