big marienville buck

anyone hear of a big droptine buck shot in marienville? i heard reports of a big one going down saturday

Once you send the picture with your phone, your ownership is basically forfeited, with no usage agreement in place before hand you are giving up your right to privacy. If you want privacy, don't share the picture in the first place. There ain't any deer left in Marienville anyway. heh heh.

Very true... an the deer wasnt killed in Marienville was killed near tionesta.

Mr Regular Joe - there are laws that protect the owner of the photo no matter who sent it to who. There are laws called "Fair USE" and its a violation to use a picture without the owners consent...it says NOTHING about transfer of ownership due to texting or emailing it. If that were the case more than quite a few would be able to claim ownership. Those that received the picture via these methods were technically breaking the law by sending along to the next person if they didn't specifically ask the owner before doing so. I know the person who actually took the pictures and he didn't text these pictures to one person..so he still owns them and has legal rights to them.
Here's what I learned about Fair Use:

It DOESN'T MATTER...

if you link back to the source and list the photographer's name
if the picture is not full-sized (only thumbnail size is okay)
if you did it innocently
if your site is non-commercial and you made no money from the use of the photo
if you didn't claim the photo was yours
if you've added commentary in addition to having the pic in the post
if the picture is embedded and not saved on your server
if you have a disclaimer on your site.
if you immediately take down a pic if someone sends you a DMCA notice (you do have to take it down, but it doesn't absolve you.)
NONE OF THAT releases you from liability. You are violating copyright if you have not gotten express PERMISSION from the copyright holder OR are using pics that are public domain, creative commons, etc.
