SB Tactical? Announces Reversal of ATF Open Letter on the Use of SB Tactical Pistol Stabilzing Braces®

Saint Petersburg, Fla. ? SB Tactical?, inventors and manufacturers of the Pistol Stabilizing Brace®, is excited to announce that the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) has issued SB Tactical a reversal letter containing a sensible clarification of the Bureau's position on the lawful use of SB Tactical braces.

The new clarification of opinion letter states, "an NFA firearm has not necessarily been made when the device is not re-configured for use as a shoulder stock ? even if the attached firearm happens to be fired from the shoulder. To the extent that the January 2015 Open Letter implied or has been construed to hold that incidental, sporadic, or situational "use" of an arm-brace (in its original approved configuration) equipped firearm from a firing position at or near the shoulder was sufficient to constitute "redesign," such interpretations are incorrect and not consistent with ATF's interpretation of the statute or the manner in which it has historically been enforced."

Good news. It's absolutely ridiculous that an ABC MOUSE government agency could arbitrarily write laws. Last time I checked we are still a constitutional republic where the laws are created by the legislature and signed off by the executive. Now to move on national reciprocal concealed carry and removing sound suppressors from the NFA!

So now the question becomes if I can shoulder a brace, why can't I just put a run of the mill stock on a sub 16 inch AR?

The NFA laws have to some of the most absurd laws on the books. They need to go ASAP.
I agree. Times have certainly changed since many of these laws or rules were enacted. The industry has certainly found ways around these laws that now make them seem silly. SBR is totally absurd to me at this point because of the number of AR and AK pistols out there. Like you said what difference does it make whether you can shoulder a pistol or SBR, it's the same darn gun! What real harm comes from a pistol with a stock? It's more accurate? gee that sounds like a reason to ban it.

There's really no need to do SBR builds anymore.

The AR pistols are more travel friendly since they aren't NFA items and you don't need to notify the ATF if you plan on taking it across state lines.

No 9 month or more waiting period and $200 tax just to attach a sub 16 inch upper to an AR 15 lower that can also be registered as a pistol and forego waiting periods and taxes.

I'd be shocked if anyone filed SBR forms anymore. You can find braces for pretty much all of the most popular "pistol" platforms: AKs, ARs, Evos, MP5s.

Let's be honest, the main reason to build an AR pistol with a brace is to go around the NFA laws, so let's just get rid of them.

I own no NFA items and I never plan to. I refuse to pay a $200 tax for something. If they ever become legal I'm all in. I give the gov. enough money as it is. I can live without NFA stuff until then.

All NFA taxes should be deemed illegal based on legal precedence.

The supreme court ruled on a case out of Boston, in the 1920s or 30s, that a tax the city was trying to impose on newspapers was illegal because they viewed it as a tax on the first amendment. They ruled constitutional amendments can't be taxed.

Apparently, taxes on the 2nd amendment are fine and dandy.

I never saw the letters from two years ago as an issue because I could care less what they wrote. I still don't care, but I'm happy to see that those "educated" folks are trying to use logic.

Some retarded laws on the books and some silly opinions being expressed by our government.
