Mineral rights question

If I have two active shallow wells on my property that gives me free gas to my house plus royalties and i have owned the property for 15 years what are the chances that I own the mineral rights for deeper gas? Thanks.

you are welcome. Only my opinion but I don't think years ago mineral rights were sold in depths. Ofcourse only a thorough deed search could tell you for sure. But I still think your chances are very good for your ownership.

I have a tentative deal on this property depending on mineral rights and am going to have the deed searched to see what is owned. Mineral rights makes the property more attractive to me.

If gas rights are not "called out" specifically on the deed! It's all yours.... no matter what depth! Good Luck!

Probably the company with the shallow wells has control. The shallow wells probably have it held by production, meaning no new lease money. Royalties for a new well would most likely be yours.

if there are no restrictions on depth in the lease then the current lease holder ie the gas company that sends you checks has the rights to sell the deep gas but you would get a royalty check for whatever the current lease says. probally an eighth. if there is a depth restriction then any gas company can contact you to lease the deeper gas. however the deep gas could have been excepted and reserved in prior deeds. you never know till an abstact is done.

take a kid hunting and fishing it will keep them out of trouble
