Sportsmen's Club small games of chance?

Everybody I've been talking to about the small games of chance license has given me different answers including elected officials who should know how this works. From what I understand, things were changed up a bit but is it true that 100% of all proceeds have to back to the community if it is a private club even though it is non-profit?

There was an amendment to the SOGC law that was passed earlier in the year that clarifies some of the confusion. As for your question, the amendment allows a club to keep the first $40,000 of net proceeds to be used towards club operating expenses. After the $40,000, the rest needs to be divided 30% max club operating expenses and a minimum 70% to benefit the general public (it can be kept by the organization, but it has to directly benefit the public). So if an organization makes a net of $60,000, they are able to keep $46,000 for general operating and the remaining $14,000 must to used to benefit the public, whether it be give it away to a 501(c)(3) non-profit or the club using it to put on a program that benefits the general public.

Thank you very much for the info. We are looking into fund raising ideas but this small games of chance license has been a sticking point.

I mispoke a bit. The amendment only passed the House and is currently sitting in the Senate, but it is likely to be passed before the reporting requirements kick in in 2014.

In that case the current law is the 30/70 ratio that I mentioned for any net proceeds.

they now also require a copy of a background check for the president and the secretary of the organization applying for the sgc liscence

I've been through enough of those with working at many government facilities but, to me, this sounds like way more hassle than what it's worth. Thanks for all the info.
