That's the exact set up the guy who was attacked had. He chose the bear spray first and the bear was not phased. His side arm was knocked off his hip during the first attack.

Being a local in Montana, he knows that had he shot the bear without first employing the pepper spray he'd be brought up on charges. Yes, I know that's dumb but that's how it is.

The feds will do a necropsy on the bear and if there's no sign of pepper spray in it's airways or lungs, they know it was shot first then sprayed. Which is something many say they would do.

Me, I would shoot the bear and get my butt off of that mountain. Then make no Facebook posts, and only tell the truth to trusted friends and family.

The level of protection afforded Grizzly bears is insane, to the point that the bear's life has more value than the human's, when these incidents are investigated.

Shoot straight

Re: bear attack

What if your only defense option was the side arm? Are you supposed to take the mauling for mother nature?

I did find this on the Montana FWP website.

"If a black or grizzly bear attacks, and if you have a firearm and know how to use it safely and effectively, Montana law allows you to kill a bear to defend yourself, another person or a domestic dog. If you do kill a bear in self defense you must report it to FWP within 72 hours."

http://fwp.mt.gov/recreation/safety/...Encounter.html

I would hope if the Feds feel differently about defending against a grizzly attack, the Montana FWP website would reflect that.

Re: bear attack

I saw the Orr posts, and agree he is a very lucky man. He was textbook on how to respond to an attack.

Don't misread me, I agree that self defense would, and should, be anyones' first reaction, legally.

But, from talking with MT hunters and ranchers over the years, the Feds will do everything they can to find the person attacked to somehow be at fault.
