I hunt on public land that is open to hunting but the corn fields are rented to a local farmer. Some years he gets the corn cut by now some years it is still standing in January. Is it legal to hunt in that corn. The area is stocked with pheasant.

Way I understand it without the permision of the farmer no you cant go thru standing corn.

Sec. 2509. Damage to property.

(a) General rule. - It is unlawful for any person while hunting game or wildlife or taking furbearers of any kind to:

(1) Cause or assist in causing damage or injury, in any manner whatsoever, to either real or personal property of any kind.

(2) Leave gates or bars open.

(3) Break down, destroy or injure fences.

(4) Tear down or scatter rail, post, wood or stone piles.

(5) Harass, injure or kill livestock of any kind.

(6) Hunt or trap in or upon unharvested buckwheat, corn, sorghum or soybean fields without the permission of the owner or person in charge of such property.

That is what I thought but I had an LMO tell me different. When I complained that the PGC should require that the farmer have all the corn cut before hunting season. I was told if it is on public land you could hunt in it.

You can hunt standing corn on game lands without permission, not on private land.

Had such a haggle many years ago, while small game hunting in Perry County. A farm we had hunted on for several years, changed hands over the summer and the new owner threw us off on opening day. We got permission to hunt another farm, up the road.

The following year when we went there to hunt, the neighbor who had thrown us off his place, had rented some of the land on the place we had permission and told us to get out of "his fields". We complied and left the areas where corn was standing, hunted on other parts of that farm.

Asked the owner what he thought and he told us to hunt wherever we wanted to, as it was his property and the other guy had just rented some of the cropland. The following weekend we hunted the corn, got the neighbor riled up again, but this time told him to take a hike. That time he left, instead of us.

Never did figure out "who was right", but went with what the actual owner said. Gray area?

At this spot some years the corn is underwater. This is on a federal flood control dam. The land is open to hunting and managed by the PGC for hunting.

Farmers that live in around State Game Lands thru out the State, some how do a contract with the PGC to Plant Different things on the SGL fields that are plantable....They plant corn, wheat, buckwheat, soybean and so forth...

As time goes along thru the summer, it either rains like mad like we had this past summer or rains here and there and we have drought conditions but just enough rain to keep those things the farmer planted to grow to harvest...


When Harvest time comes, Farmer goes in and looks over the Corn and Soybeans and decides if there is to much Moisture content in it or just the right amount for picking and storing....

When the Moisture content is at the right place, the farmers go and pick the corn or soybean... it then Stores better for them to use as animal feed and does not mold on them that they have to trash it and take a lose!

Sometimes, that moisture content can take till into December/January to get to the right point, other times, BAM it is at the right point in Mid to end of October!

Now, also you have to remember that an agreement is made by the PGC with the Farmer who wants to Farm the land on SGLs....the Farmer Has to let so much crop on the SGL as Critter food for the Wild critters!

Please, READ THIS CAREFULLY

If it is State Game Lands, or under a lease agreement like Indian Rock Dam (US Army Corp Of Engineer Prop in York County) then the farmer is a Sharecropper who has a contract with the PGC to farm that land. The PGC is THE LANDOWNER and gives YOU the hunter BLANKET PERMISSION to hunt in the UNHARVESTED CROPS. As explained earlier, a percentage of some crops are required to be left standing by the Sharecropper, for wildlife. In some years farmers are delayed in their harvest due to environmental factors and the full crop stays up longer.

Either way, you are ALLOWED to hunt in UNHARVESTED FIELDS on STATE GAME LAND -->>

That does NOT apply to:

Farm Game Projects,
Safety Zone Program Farms,
Forest Game Projects,
State Parks
or other Cooperative Programs.

These are all PRIVATE agreements between the landowners and the PGC. You MUST have the FARMER'S permission to hunt in any unharvested fields! at these locations.
